These terms and conditions (the "Terms") govern access to and use of the MYLANA website (the "Site") as well as the purchase of any MYLANA product (the "Products").

By accessing the Site or making a purchase, you acknowledge that you have read, understood, and agreed to be bound by these Terms, without restriction or reservation.

MYLANA reserves the right to modify these Terms at any time. The applicable Terms are those in effect on the date of your order.

1. SERVICE AREA

MYLANA Products are sold and delivered exclusively in Canada.
MYLANA currently offers no international delivery.

Any order placed with a delivery address outside Canada may be refused, canceled, or refunded, at the sole discretion of MYLANA.

2. PRODUCTS, CONTENT, AND AVAILABILITY

Products, descriptions, ingredients, features, sizes, visuals, prices, and availability presented on the Site are subject to change at any time without notice.

Images and descriptions are provided for informational purposes only. MYLANA does not guarantee that the display of colors or textures on your screen accurately reflects the actual product.

MYLANA reserves the right to limit quantities purchased, refuse an order, or remove a product from the Site without notice.

3. VARIABLE RESULTS – NO GUARANTEE OF RESULTS

MYLANA Products are cosmetics intended to improve the appearance of the skin, eyelashes, or lips.

3.1 Variable results depending on the individual

Results may vary from person to person depending on several factors, including but not limited to:

• skin or eyelash type,

• frequency and consistency of use,

• lifestyle habits,

• overall skincare routine,

• individual reactions.

MYLANA does not guarantee any specific, uniform, or permanent results.

 

3.2 No promise or guarantee

Testimonials, customer reviews, before/after photos, test results, or usage examples presented on the Site or on social media reflect individual experiences and do not constitute a guarantee of results.

No MYLANA Product is intended to diagnose, treat, cure, or prevent any medical or dermatological condition.

4. PRICES AND PAYMENT TERMS

• All prices are shown in Canadian dollars (CAD).

• Prices do not include applicable taxes or delivery fees, which are added at checkout.

• Payments are made by credit card (Visa, Mastercard, American Express).

• MYLANA uses secure payment platforms.

By placing an order, you authorize MYLANA to collect the total amount of your purchase, including applicable taxes and fees.

5. SHIPPING AND DELIVERY (CANADA ONLY)

5.1 Order Processing

Orders are generally prepared and shipped within 1 to 2 business days, subject to availability.

5.2 Delivery Times

Delivery times vary depending on the destination and carrier (e.g., GLS Courier, Purolator) and are provided for informational purposes only.

5.3 Transfer of Risk

Delivery is deemed complete and the risk of loss or damage is transferred to the customer upon delivery of the package to the carrier.
MYLANA is not responsible for delays, losses, or damages caused by the carrier.

5.4 Shipping Costs

• Fixed shipping cost in Canada: $12.99 CAD

• Free shipping for orders of $98 CAD and more before taxes

5.5 Delivery Address

You are responsible for providing a complete and accurate address.
Any package returned due to an incorrect, incomplete address, refusal of delivery, or an unclaimed package may incur re-shipping fees.

6. ORDER MODIFICATION OR CANCELLATION

Orders are processed quickly and cannot be modified or canceled once shipped.

Any request for modification or cancellation must be submitted before shipment to info@mylana.ca. MYLANA does not guarantee that a modification will be possible after order confirmation.

7. RETURN POLICY – FINAL SALES

For hygiene, safety, and cosmetic compliance reasons, all sales are final.

No returns or exchanges are accepted, except in the following cases:

• defective product upon receipt,

• missing item,

• documented skin reaction (on a case-by-case basis).

Any claim must be made within 14 days of receipt of the order to info@mylana.ca.

8. ORDER ACCURACY

Receipt of a confirmation email does not constitute final acceptance of the order.
MYLANA reserves the right to cancel an order in case of pricing error, description error, availability error, or suspected fraud.

9. SITE USAGE AND SECURITY

The Site is intended for personal, non-commercial use.
It is prohibited to:

• attempt to access unauthorized systems,

• disrupt the security or operation of the Site,

• transmit viruses or harmful content,

• use the Site for fraudulent or illegal purposes.

MYLANA reserves the right to suspend or restrict access to the Site without notice.

10. INTELLECTUAL PROPERTY

All content on the Site (texts, images, videos, logos, brands, design, etc.) is the exclusive property of MYLANA or its partners and is protected by applicable laws.

No reproduction, distribution, or commercial exploitation is permitted without prior written consent.

11. USER CONTENT AND SOCIAL MEDIA (UGC)

By tagging @mylana.cosmetiques, using hashtags associated with MYLANA, or posting content mentioning MYLANA products, you authorize MYLANA Cosmetics to use, reproduce, and reshare this content for marketing and promotional purposes on its digital platforms.

 

12. PRIVACY

The collection and use of your personal information are governed by the MYLANA Privacy Policy, which is an integral part of these Terms.

13. LIMITATION OF LIABILITY

To the extent permitted by law, MYLANA shall not be held liable for any direct or indirect damage resulting from the use of the Site or the Products.

The use of MYLANA Products is at your sole risk.

14. INDEMNIFICATION

You agree to indemnify and hold MYLANA harmless from any liability arising from your use of the Site, your violation of these Terms, or any claim related to your content or conduct.

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the province of Quebec and the applicable federal laws of Canada.

Any dispute will be submitted to the competent courts of the judicial district of MYLANA’s domicile.
