These terms and conditions (the “Terms”) govern access to and use of the MYLANA website (the “Site”) and the purchase of any MYLANA product (the “Products”).

By accessing the Site or making a purchase, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions, without restriction or reservation.

MYLANA reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of your order.

1. AREA SERVED

MYLANA products are sold and delivered exclusively in Canada .
MYLANA does not currently offer any international delivery .

Any order placed with a delivery address located outside of Canada may be refused, cancelled or refunded, at MYLANA's sole discretion.

2. PRODUCTS, CONTENT AND AVAILABILITY

The Products, descriptions, ingredients, characteristics, formats, visuals, prices and availability presented on the Site are subject to change at any time without notice.

Images and descriptions are for illustrative purposes only. MYLANA does not guarantee that the colors or textures displayed on your screen will accurately reflect the actual product.

MYLANA reserves the right to limit quantities purchased, refuse an order or remove a product from the Site without notice.

3. VARIABLE RESULTS – NO GUARANTEE OF RESULTS

MYLANA products are cosmetics designed to improve the appearance of skin, eyelashes or lips.

3.1 Results vary depending on the individual

Results may vary from person to person depending on several factors, including:

• the type of skin or eyelashes,

• the frequency and consistency of use,

• lifestyle habits,

• the overall skincare routine,

• individual reactions.

MYLANA does not guarantee any precise, uniform or permanent results.

3.2 Absence of promise or guarantee

Testimonials, customer reviews, before/after photos, test results or examples of use presented on the Site or on social networks reflect individual experiences and do not constitute a guarantee of results .

No MYLANA product is intended to diagnose, treat, cure, or prevent any medical or dermatological condition.

4. PRICE AND PAYMENT TERMS

• All prices are displayed in Canadian dollars (CAD) .

• Prices do not include applicable taxes or delivery charges, which are added at checkout.

• Payments are made by credit card (Visa, Mastercard, American Express).

• MYLANA uses secure payment platforms.

By placing an order, you authorize MYLANA to collect the total amount of your purchase, including applicable taxes and fees.

5. SHIPPING AND DELIVERY (CANADA ONLY)

5.1 Order Processing

Orders are usually prepared and shipped within 1 to 2 business days , subject to availability.

5.2 Delivery times

Delivery times vary depending on the destination and the carrier (e.g., GLS courier, Purolator) and are provided for guidance purposes only.

5.3 Risk Transfer

Delivery is deemed to have been completed and the risk of loss or damage is transferred to the customer upon handing the package over to the carrier .
MYLANA is not responsible for delays, losses or damages caused by the carrier.

5.4 Delivery charges

• Fixed fees in Canada: $9.99 CAD

• Free shipping on all orders of $98 CAD or more before taxes

5.5 Delivery address

You are responsible for providing a complete and accurate address.
Any package returned due to an incorrect or incomplete address, refusal of delivery, or an unclaimed package may incur reshipping fees.

6. ORDER MODIFICATION OR CANCELLATION

Orders are processed quickly and cannot be modified or cancelled once shipped .

Any request for modification or cancellation must be sent to info@mylana.ca before shipment . MYLANA does not guarantee that a modification will be possible after order confirmation.

7. RETURN POLICY – FINAL SALES

For reasons of hygiene, safety and cosmetic compliance, all sales are final .

No returns or exchanges are accepted, except in the following cases:

• product was defective upon receipt.

• missing article

• documented skin reaction (on a case-by-case basis).

Any claim must be made within 14 days of receiving the order to info@mylana.ca .

8. ACCURACY OF COMMANDS

Receiving a confirmation email does not constitute final acceptance of the order.
MYLANA reserves the right to cancel an order in case of error in price, description, availability or suspected fraud.

9. SITE USE AND SECURITY

The Site is intended for personal and non-commercial use.
It is forbidden to:

• attempting to access unauthorized systems,

• disrupt the security or operation of the Site,

• transmit viruses or harmful content,

• using the Site for fraudulent or illegal purposes.

11. USER CONTENT AND SOCIAL MEDIA (UGC)

By tagging @mylana.cosmetiques, using hashtags associated with MYLANA, or posting content mentioning MYLANA products, you authorize MYLANA Cosmétiques to use, reproduce, and reshare this content for marketing and promotional purposes on its digital platforms.

12. CONFIDENTIALITY

The collection and use of your personal information is governed by the MYLANA Privacy Policy , which forms an integral part of these Terms.

13. LIMITATION OF LIABILITY

To the extent permitted by law, MYLANA shall not be liable for any direct or indirect damages resulting from the use of the Site or the Products.

The use of MYLANA Products is entirely at your own risk.

14. COMPENSATION

You agree to indemnify and hold MYLANA harmless from any liability arising from your use of the Site, your breach of these Terms, or any claim related to your content or conduct.

15. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of the Province of Quebec and the applicable federal laws of Canada.

Any dispute will be submitted to the competent courts of the judicial district of MYLANA's domicile.
